This agreement is effective immediately upon your first use of our services

1. Acceptance of Terms

By accessing or using Tech ProFixer ("Platform", "We", "Our", "Us"), you agree to be legally bound by these Terms of Service, our Privacy Policy, and Refund Policy. This agreement constitutes a legally binding contract between you and Tech ProFixer.

⚠️ Non-Negotiable: These terms are non-negotiable. Continued use after any changes constitutes acceptance.

2. Services Description

Tech ProFixer operates as a multi-vendor IT services marketplace connecting customers with independent service providers ("Vendors").

Our Role:

  • Platform Provider: We provide the marketplace infrastructure
  • Payment Processor: Secure transaction handling
  • Dispute Mediator: Resolution support between parties
  • Quality Monitor: Vendor performance tracking

⚠️ Important: Tech ProFixer is NOT a direct service provider. We act as an intermediary platform.

3. User Accounts & Responsibilities

Account Creation:

  • Must be 18+ years old to create an account
  • Provide accurate, current, and complete information
  • One account per individual/organization
  • Immediate notification of unauthorized access

User Responsibilities:

  • Maintain account security (password confidentiality)
  • Accept responsibility for all account activities
  • No fraudulent, abusive, or illegal activities
  • Respect vendor and customer rights
  • Prompt response to service-related communications

Prohibited Activities:

  • Creating multiple accounts to circumvent restrictions
  • Impersonating others or providing false information
  • Attempting to gain unauthorized access
  • Interfering with platform operations
  • Harassing other users or vendors

4. Vendor Terms & Conditions

Vendor Requirements:

  • Verification: Submit valid business registration documents
  • Qualifications: Provide proof of technical certifications
  • Insurance: Maintain valid professional liability insurance
  • Background Check: Pass our vendor screening process

Vendor Obligations:

  • Service Quality: Maintain high-quality service standards
  • Timeliness: Honor all scheduled appointments
  • Professionalism: Maintain professional conduct
  • Warranty: Honor advertised warranty periods
  • Communication: Respond within 24 hours to inquiries

Commission Structure:

  • Service Commission: 7% of total service value
  • Product Commission: 5% of product sales
  • Platform Fee: Monthly subscription (if applicable)
  • Payment Schedule: Bi-weekly settlements

5. Payments, Pricing & Financial Terms

Payment Methods Accepted:

  • Cash on Delivery (COD) - Service locations only
  • Bank Transfer/IBFT
  • Credit/Debit Cards (Visa, MasterCard)
  • Mobile Wallets (EasyPaisa, JazzCash)
  • Online Banking

Pricing Policy:

  • All prices in Pakistani Rupees (PKR)
  • Prices include all applicable taxes
  • Vendors set their own service/product prices
  • We reserve right to modify commission rates with 30-day notice

Payment Terms:

  • Customers: Full payment before service initiation
  • Vendors: Receive payment within 7-14 days after service completion
  • Refunds: Processed within 7-14 business days (see Refund Policy)
  • Chargebacks: Result in immediate account suspension + legal action

6. Warranty & Returns Policy

Product Warranty:

  • New Products: 1-year manufacturer warranty
  • Refurbished: 90-180 days warranty
  • Used Products: 30 days testing warranty
  • Accessories: 15 days replacement warranty

Service Warranty:

  • Hardware Repair: 90 days on repaired components
  • Software Installation: 30 days troubleshooting support
  • Network Setup: 60 days configuration support
  • Data Recovery: 7 days verification period

⚠️ Important: Warranty is VOID if service/product is tampered with by unauthorized personnel.

7. Limitation of Liability & Disclaimers

Limitation of Liability:

  • We are NOT liable for vendor actions/inactions
  • Maximum liability limited to service/product cost
  • No liability for incidental/consequential damages
  • Not responsible for data loss during services
  • Not liable for delays beyond our control

Service Disclaimers:

  • Services provided "as is" and "as available"
  • No guarantee of 100% data recovery success
  • No warranty on used/refurbished parts lifespan
  • Compatibility issues are customer's responsibility

Force Majeure:

Not liable for failures due to events beyond reasonable control including: natural disasters, war, terrorism, government actions, pandemics, internet outages, or supplier failures.

8. Termination & Suspension

We May Terminate/Suspend For:

  • Violation of these Terms of Service
  • Fraudulent or illegal activities
  • Non-payment of fees/commissions
  • Multiple customer complaints
  • Creating risk/legal exposure for us
  • Abuse of platform or other users

Consequences of Termination:

  • Immediate account deactivation
  • Loss of access to all services
  • Forfeiture of any pending payments
  • Legal action for damages (if applicable)
  • Permanent ban from platform

User Termination Rights:

You may terminate your account at any time by contacting support. Outstanding obligations must be settled before termination.

9. Changes to Terms

Modification Rights:

  • We reserve right to modify terms at any time
  • Significant changes notified via email/platform
  • Continued use = acceptance of new terms
  • Archive of previous terms available on request

Notification Methods:

  • Email to registered address
  • Platform announcements/banners
  • Updated "Last Updated" date
  • In-app notifications

⚠️ Your Responsibility: Regularly review terms. Continued use after changes constitutes binding acceptance.

Dispute Resolution Process:

  1. Direct Negotiation: Attempt resolution with other party
  2. Platform Mediation: Submit dispute via support ticket
  3. Formal Complaint: Escalate to legal@techprofixer.com
  4. Legal Action: Courts in Karachi, Pakistan have jurisdiction

Governing Law:

These Terms are governed by and construed in accordance with the laws of Pakistan. Any disputes shall be subject to the exclusive jurisdiction of courts in Karachi.

BY USING TECH PROFIXER'S PLATFORM AND SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY ALL TERMS AND CONDITIONS STATED ABOVE.
